Con­ver­si­on of cash regis­ters: German States extend dead­line until 31 March 2021

The law on pro­tec­tion against mani­pu­la­ti­on of basic digi­tal record­ings came into force at the end of Decem­ber 2016. It sti­pu­la­tes that within three years a Cer­ti­fied Tech­ni­cal Secu­ri­ty Device (TSE) is to be deve­lo­ped for all common POS sys­tems and cer­ti­fied by the Federal Office for Infor­ma­ti­on Secu­ri­ty (BSI). The German Federal Minis­try of Finan­ce grants a no objec­tion rule until 30 Sep­tem­ber 2020, as it was not yet pos­si­ble to upgrade the elec­tro­nic record­ing sys­tems across the board at the begin­ning of the year.

The period of the non-com­p­laint regu­la­ti­on has now been exten­ded by all federal states — with the excep­ti­on of Bremen — until 31 March 2021. The regu­la­ti­on for the exten­si­on of the dead­line is thus sub­ject to the indi­vi­du­al federal states. By 30 Sep­tem­ber 2020, affec­ted com­pa­nies must be able to prove that they have com­mis­sio­ned a spe­cia­list cash regis­ter retailer, cash regis­ter manu­fac­tu­rer or other ser­vice pro­vi­der in the cash regis­ter area with the timely instal­la­ti­on or inte­gra­ti­on of a cloud-based TSE.

In the federal states of Bran­den­burg, Lower Saxony and Saxony, the dead­line for pla­cing an order is 31 August 2020; in the federal state of Berlin, the bin­ding order must be placed by 30 August 2020.

Exten­ded grace period in eight german federal states

The finan­ce minis­ters of Hesse, Bava­ria, North Rhine-West­pha­lia, Ham­burg and Lower Saxony have agreed to find a prag­ma­tic and unbu­reau­cra­tic solu­ti­on to meet the TSS obli­ga­ti­on. Baden-Würt­tem­berg, Saar­land and Schles­wig-Hol­stein, have alrea­dy fol­lo­wed the first five federal states.

Accord­in­gly, the dead­line will be exten­ded until 31 March 2021 if

  • - a cloud TSS is to be imple­men­ted, but it has not yet been proven to be avail­ab­le. Proof of unavai­la­bi­li­ty would be the status ‘In Cer­ti­fi­ca­ti­on’ (BSI-DSZ-CC-1130BSI-DSZ-CC-1153).
  • - a TSS has been orde­red or a cash regis­ter manu­fac­tu­rer has been com­mis­sio­ned with the bin­ding and timely instal­la­ti­on of a TSS. A bin­ding order can be a con­tract signed by both parties.

Modern fis­ca­liz­a­ti­on solu­ti­on: fis­ka­ly and Mar­kant enter into long-term partnership

The Mar­kant Group, the lar­gest ser­vice coope­ra­ti­on for sup­pliers and dea­lers in Ger­ma­ny and Europe, con­clu­des a long-term part­ners­hip with fis­ka­ly.

This part­ners­hip enab­les Markant’s tra­ding part­ners to imple­ment a scala­b­le and modern fis­ca­liz­a­ti­on solu­ti­on for the cash secu­ri­ty ordi­nan­ce. The inter­na­tio­nal ori­en­ta­ti­on of both com­pa­nies fits tog­e­ther very well.



fis­ka­ly Cloud-TSS does NOT requi­re any hardware!

On this occa­si­on we would like to cla­ri­fy that the TSE solu­ti­on from fis­ka­ly is a pure soft­ware solu­ti­on and does not con­tain any hard­ware com­po­nent (at the cash regis­ters) in any form.

We would also like to point out that fis­ka­ly SMAERS does not use TPM (Trus­ted Plat­form Module).

Fully inte­gra­ted imple­men­ta­ti­on of Cloud TSE for SAP ERP and S/4HANA

The coope­ra­ti­on bet­ween fis­ka­ly and snap resul­ted in a spe­cial solu­ti­on for SAP ERP and S/4HANA, which enab­les a fully inte­gra­ted imple­men­ta­ti­on of a Cloud TSSE. The ABAP based TSS can be inte­gra­ted into exis­ting SAP POS cash sales pro­ces­ses either by itself or by an “all-round care­free package”.

The solu­ti­on also enab­les opti­miz­a­ti­on at the POS: pay­ment ter­mi­nals such as Hobex, Wire­card, Six or Card­com­ple­te can be inte­gra­ted direct­ly into the SAP or S/4HANA system! 



Part­ners­hip of fis­ka­ly GmbH with EFSTA

Effi­ci­ent and cost-effec­ti­ve imple­men­ta­ti­on of the Kassensicherungsverordnung.

From Octo­ber 2020, cash regis­ter sys­tems must be adap­ted in accordance with the Kas­sen­si­che­rungs­ver­ord­nung. Howe­ver, the regu­la­ti­ons and chal­len­ges asso­cia­ted with this will create hurd­les for many com­pa­nies. Com­pa­nies can now bene­fit from a new solu­ti­on: fis­ka­ly GmbH’s part­ners­hip with EFSTA has resul­ted in a com­ple­te packa­ge that meets and covers the requi­re­ments of the Kassensicherungsverordnung.

Cur­rent status of the eva­lua­ti­on process

Since Novem­ber 2019, the fis­ka­ly TSS has been offi­cial­ly under eva­lua­ti­on. Cur­r­ent­ly, all three com­pon­ents (SMAERS, CSP‑L and TSS TR) have been assi­gned cer­ti­fi­ca­ti­on IDs. Thus fis­ka­ly had the first Cloud-SMAERS in cer­ti­fi­ca­ti­on and a lead of 3 months over the competition.

We are happy that ever­ything is going accord­ing to plan and that the eva­lua­ti­on is run­ning smoothly!


All-in-One POS data solu­ti­on: Receipt4S® and Cloud TSE from fiskaly

Until Sep­tem­ber 2020 retailers have to upgrade their POS sys­tems in accordance with the Kas­sen­SichV. SAP® cus­to­mers can now bene­fit from a new solu­ti­on: a coope­ra­ti­on bet­ween Con­sult-SK GmbH and fis­ka­ly has resul­ted in an add-on that serves as a cen­tral entry point to cash regis­ter data manage­ment, which brings along the TSS right away.

We are happy about this mile­stone! Our app­li­ca­ti­on for BSI cer­ti­fi­ca­ti­on was suc­cess­ful: The fis­ka­ly TSE is cur­r­ent­ly under­go­ing eva­lua­ti­on and has recei­ved a cer­ti­fi­ca­ti­on ID.

This is the first time that a cloud-based TSE is in the eva­lua­ti­on process.
