The fiskaly TSS has been officially under evaluation since November 2019. Currently, all three components **(SMAERS, CSP-L and TSS TR)** have been assigned certification IDs. Thus, **fiskaly** had the **first cloud SMAERS in certification** and a head start of 3 months over the competition.
We are happy that everything is going according to plan and that the evaluation is proceeding swiftly!

fiskaly has written information and assurances from stakeholders from the federal ministries involved in the KassenSichV. There is consensus that the fiskaly Cloud TSS can be operated as a TSS in compliance with the law beyond 31 March 2021. For this, the Cloud TSS must now be rolled out and activated.

On 31.12.2022, the transition period in Germany for cash registers that cannot be retrofitted with a technical security system will end. From 01.01.2023, you may only use POS with a valid TSS.

A separate transition period is applied to POS, which cannot be equipped with a technical security system due to their construction. Therefore these POS devices must be replaced with modern POS devices by the end of the year.

On 31.12.2022, the transition period in Germany for cash registers that cannot be retrofitted with a technical security system will end. From 01.01.2023, you may only use POS with a valid TSS.

The Chief Finance Ministers of **Hesse, Bavaria, North Rhine-Westphalia, Hamburg and Lower Saxony** have agreed to reach a pragmatic and unbureaucratic solution for fulfilling the TSS obligation. **Baden-Württemberg, Saarland** and **Schleswig-Holstein** have already followed the first five federal states.
Accordingly, the deadline will be extended until **31 March 2021** in case:
* a **Cloud TSS** is to be installed but is demonstrably not yet available.

* a **TSS has been ordered** or a cash register manufacturer has been commissioned with the **binding and timely installation** of a TSS. 
A binding order can be a contract signed by both parties.

**Efficient and cost-effective implementation of the Cash Register Security Ordinance.**
From October 2020, cash register systems must be adapted in accordance with the Cash Register Security Ordinance. But the accompanying regulations and challenges bring hurdles for many companies. Companies are now benefiting from a new solution: through the partnership of fiskaly GmbH with **[EFSTA](https://www.efsta.eu/at/)**, an all-in-one package has been created that fulfills and covers the regulations of the Cash Register Security Ordinance.
Although the Cash Register Security Ordinance officially came into force on 1 January 2020, companies will not have to equip their cash registers with a technical security system (TSS) until 1 October 2020, so that the manipulation protection of the recorded data is guaranteed and the data can no longer be changed afterwards.
The challenges that companies now face can be mastered through the cooperation of fiskaly GmbH and EFSTA. The combination of EFSTA's international fiscal solutions and extensive services with fiskaly's Cloud TSS offers a comprehensive and efficient solution to the cash register security regulation and also enables the regulations to be covered in compliance with the law.
Through EFSTA's solution, on the one hand, different national fiscal regulations can be unified in a standardised interface and, on the other hand, cash register systems can be easily rolled out to other countries. The extensive functions and services of EFSTA are complemented by the advantages of the fiskaly Cloud TSS.
The fiskaly Cloud TSS is a future-oriented and innovative solution that brings many advantages compared to a hardware TSS. As the technical security device of fiskaly is cloud-based, the cash register security regulation can be implemented in a contemporary manner. Subsequently, there is an enormous cost saving, as no hardware is required and therefore no expensive investments have to be made. If there are legal changes, the TSS is adapted to the changes so that it always fulfils the legal requirements. Once centrally integrated, all tills can be upgraded to comply with the law via a simple software update.

In cooperation with the Hessian tax authorities and various industry partners, we have initiated the test phase for the automated transmission of cash register data to tax authorities in accordance with [§146a (4) AO](https://www.heimpel.com/download/bmf_schreiben/2019-06-17-einfuehrung-paragraf-146a-AO-anwendungserlass-zu-paragraf-146a-AO.pdf).
This week marked a significant milestone: the first cash register report was successfully transmitted to the tax office via the fiskaly Submission API. On 25 June 2021, Bundesrat approved the ordinance amending the Cash Security Regulation. The addition to § 6 sentence 2 KassenSichV makes it possible that certain information does not have to be printed in plain text on a receipt, but can be displayed in a QR code.

fiskaly receives SMAERS certification from the German Federal Office for Information Security (BSI). These components are core components of the fiskaly Cloud TSS. The final TR test checks our system as a whole.

The deadline for the non-objection rule, which is granted by the Federal Ministry of Finance (BMF) until 30 September 2020, has now been extended by 15 federal states until 31 March 2021. 
Bremen follows the guidelines of the BMF. The regulation for the deadline extension is thus subject to the individual federal states. By **30 September 2020**, affected businesses must be able to prove that they have commissioned a specialist cash register dealer, cash register manufacturer or other service provider in the cash register sector with the timely installation or integration of a cloud-based TSS. 
In the federal states of Brandenburg, Lower Saxony and Saxony, the commissioning deadline is **31 August 2020**. In the federal state of Berlin, a binding order must have been placed by **30 August 2020**.

The cooperation between fiskaly and [snap](https://www.snapconsult.com/) resulted in a special solution for SAP ERP and S/4HANA that enables a **fully integrated implementation** of a Cloud TSS.
